Privacy Policy
Private by design
- Lumivo makes everything on your device. It never uploads your photos, music or videos, and we never receive them.
- There is no account, no ads and no tracking. The App has no advertising, usage-analytics or push-messaging tools, and we never sell personal data.
- Crash reports and performance data only if you turn them on. Both switches start off; you can change them during setup or at any time in Settings › Privacy. Google Firebase (Crashlytics and Performance Monitoring) processes these reports for us, and they never include your photos, videos, music or drafts (section 5).
- Apart from those reports, the App's own code on Android never connects to the internet. On iPhone and iPad, it only asks Apple's App Store whether a newer version is available.
- Google Play and the Apple App Store handle subscriptions, and we never see your payment details. On Android, Google Play's billing library in the App sends Google its own diagnostic data, which we do not receive.
- If you email us, we use your message only to reply to you.
1. Who we are
Lumivo (the "App") is developed by Chamela Aluthgedara (Chamela Laboratory, "we", "us", "our"), based in Sri Lanka, and published on Google Play and, when available, on the Apple App Store. We are responsible for the personal data described in this policy and act as its data controller.
Contact: apps.support@ailivex.com.
2. Scope
This policy covers the App and this web page. Services run by others, such as Google Play, the App Store, Google Firebase, your email provider and the apps you share with, have their own privacy policies, which we link to below.
This web page is served by Cloudflare, which processes standard connection data, such as your IP address and browser details, to deliver the page and protect the site. The page itself sets no cookies and loads no analytics or tracking scripts.
3. Information that stays on your device
The App works on your device. Editing, motion, effects, rendering and video encoding all run there, and the App's soundtracks are synthesized there. The following is processed and stored only on your device. It is not sent to us or to anyone else, except as described in sections 4 to 6:
- the photos you pick in the system photo picker and the audio files you pick in the system file picker. The App copies them into its private storage: each photo is saved again as a new image without its location and camera metadata, and the picker's temporary copy is deleted;
- your drafts and the videos, GIFs and photos you create;
- your settings, what you choose when you set up the App, and your creative streak and achievements;
- your Pro status: what the store last confirmed (whether Pro is on, the plan and product, its renewal status and expiry date, and when it was checked) is kept in the system's secure storage (Android Keystore or iOS Keychain), together with a reading of the device clock that lets the App notice when the clock is set back;
- a short diagnostics log, described below.
Diagnostics log. To help solve problems, the App keeps a technical log of at most 300 entries on your device: events and errors, such as an export that finished or failed, the subscription status the store reported and the results of the integrity checks in section 11, and performance details such as the type of graphics processor, with the App version and platform. The App removes file paths and file names from it, and it never contains your photos, audio or creations. It is never sent automatically and is not part of crash reports; it reaches us only if you choose to include it in a support email (section 4).
Saving and sharing. When you export a video, a GIF or a silky photo, or save an edited photo, the App keeps it in its own storage and also saves it to your gallery (on iPhone and iPad, to Photos), unless you turn off Settings › Save exports to gallery; you can still save it later from the App. A Live Photo, on iPhone and iPad, is saved to Photos. Photos and videos the App saves carry no location or camera metadata. Files you save to your gallery or share with other apps are then under your control, and your device's own backup and photo-sync settings apply to them. On Android, a creation you set as your live wallpaper is copied into the App's storage and played from there by the App's wallpaper service.
This information stays in the App's private storage until you delete it, use Settings › Privacy › Erase all data, clear the App's data or uninstall the App. On Android, the App excludes its data from cloud backup and from device-to-device transfer. On iPhone and iPad, the App excludes its drafts, creations and settings from iCloud and computer backups, and its secure storage stays on this device only.
4. Information we collect
Apart from the crash reports and performance data in section 5, which the App sends only if you turn them on, the only personal data we receive is what you send us when you contact us, for example through Settings › Contact support, which opens your email app with a message to us.
- What we receive: your email address, your name if your email shows it, and the content of your message, including any attachments. The message is pre-filled with the App version and build and your device's operating system and its version. If you tick "Include diagnostics" (it stays off unless you tick it), the diagnostics log described in section 3 is added to the message text, where you can read it, or delete it, before you send the message.
- What we use it for: replying to you, solving the problem you report and improving the App.
- How long we keep it: up to 24 months after the conversation ends. We keep it longer only if the law requires it, and we delete it sooner if you ask.
We do not collect anything else, and the App reports to no server of ours: crash reports and performance data go to Google Firebase, which processes them for us (section 5). The App has no advertising, usage-analytics, push-messaging or tracking tools. It does not use advertising identifiers, and it does not access your location, contacts, camera or microphone. On Android, Google Play's billing library sends Google its own diagnostic data, which we do not receive (see section 6).
5. Crash reports and performance data (Google Firebase)
To help us fix crashes and make the App faster, you can let it send two kinds of technical reports to Google Firebase. Each has its own switch, and both are off until you turn them on: on the privacy page during setup, or at any time in Settings › Privacy or on the privacy dashboard. Until you turn one on, the App does not start Firebase and sends it nothing. Only release builds of the App, the ones published in the stores, send reports.
Crash reports (Firebase Crashlytics). While this switch is on, when the App crashes or meets an error, it sends Google a report with:
- the error and its stack trace, which shows where in the App's code it happened. The App removes file paths and file names from the errors it reports; a crash in the device's system code or in the App's native code is reported as the system describes it, which can occasionally include a file name or path;
- the App's version, the device model and processor type, the operating system and its version, and the device's state at the time, such as screen orientation, free memory and storage, whether the App was in the background, and whether the device is rooted or jailbroken;
- random identifiers for this installation of the App (a Crashlytics installation ID and a Firebase installation ID).
Performance data (Firebase Performance Monitoring). While this switch is on, the App sends Google:
- timings: how long the App takes to start, how long it stays in the foreground or in the background, and how smoothly its screens render;
- technical details, such as the device model, the operating system and its version, the App's version, the device's language, screen orientation, memory and storage size, processor use, the type of network connection (for example Wi-Fi or mobile data) and the mobile carrier, and the country, which Google derives from your IP address;
- a random Firebase installation ID, which Firebase also uses to fetch its reporting settings.
The App makes no network requests of its own for Performance Monitoring to measure, apart from the update check on iPhone and iPad (section 6), which Performance Monitoring does not measure.
Neither kind of report ever includes your photos, videos, music, drafts or creations. Neither uses an advertising identifier or a user ID, and neither is linked to your name, email address or any account.
Turning them off. Turning a switch off stops that collection at once. Turning off crash reports also deletes the crash reports not yet sent.
Retention. Google keeps crash reports for up to 90 days, and performance data for a limited period set by Google.
Firebase processes these reports for us as our service provider (data processor), under the Firebase Data Processing and Security Terms. See Privacy and Security in Firebase and Google's Privacy Policy.
6. Information handled by third parties
Google Play and the Apple App Store. The stores handle downloads, payments, subscriptions, refunds, rating prompts and updates. They process your account and payment information as independent controllers, under Google's and Apple's privacy policies. To check your Pro status, the App asks the store, when it starts and when you return to it, which of the App's products your store account owns, and receives purchase confirmations, such as the product, a purchase token or transaction, and the subscription's renewal or expiry status. It checks them on your device, keeps only the Pro status listed in section 3, and never sends them to us.
Google Play's billing library (Android). To sell, check and restore Pro on Android, the App includes Google Play's billing library, which works with the Google Play Store app on your device. The App uses it at every start, even if you never buy anything, and from then on the library can send Google its own diagnostic information about how it works, with technical details of your device and of the App. Google handles it under its own terms and Privacy Policy; we do not receive it, and the App never gives the library your photos or creations. The Android App holds the internet permission for this library and for crash reports and performance data, which are sent only if you turn them on (section 5); the App's own code never uses it. On iPhone and iPad, purchases use Apple's in-app purchase system (StoreKit), which is part of iOS.
Update checks. When the App starts and when you return to it (at most every 30 minutes), it checks whether a newer version is available. If one is, the App asks you to install it, and some updates must be installed before you can keep using the App. The App never downloads or installs code by itself; the store installs updates.
- On Android, the App asks the Google Play Store app on your device, through Google Play's in-app update service. Google Play handles this under Google's terms.
- On iPhone and iPad, the App asks Apple's public App Store lookup service (itunes.apple.com) for the App's current version. The request contains only the App's identifier, the two-letter code of the region set on your device and the App's name as its browser identification, with standard connection data, such as your IP address, that Apple receives. It contains no identifier of you or your device. Apart from crash reports and performance data, if you turn them on (section 5), this is the only network request the App's own code makes.
Rating prompts. After you have finished a few creations, the App may ask Google Play or the App Store to show its rating prompt; the store decides whether to show it. If you rate or review the App, the store handles it under its own terms.
Links, email and sharing. When you open a store page, this web page or another link, send an email, or share a creation through the system share sheet, the app or website you choose takes over, and its own policy applies from that point.
7. How we use information and our legal bases
- Providing the App and the Pro features you buy: performance of our contract with you.
- Crash reports and performance data: your consent, given with each switch. You can withdraw it at any time with the same switch; this does not affect processing that took place before.
- Answering your messages: our legitimate interest in helping you, or taking steps you ask for.
- Keeping the App and purchases secure, for example by checking purchases and app integrity on your device: our legitimate interest in preventing fraud and misuse.
- Selling Pro through Google Play on Android, including the diagnostics Google Play's billing library sends Google: our legitimate interest in offering reliable purchases. Google processes that information under its own terms.
- Meeting legal obligations: compliance with law.
- Adding to your photo library on iPhone and iPad, and storage access on Android 8 and 9: only with the permission you grant. You can withdraw it at any time in your device settings.
8. Permissions
- Photos: none to pick photos. The App uses the system photo picker, so it receives only the photos you select and never sees the rest of your library.
- Saving to your gallery: on iPhone and iPad, add-only access to your photo library, asked for the first time the App saves a creation; it lets the App add to your library, never read it. On Android 10 and later, no permission is needed; on Android 8 and 9, the App asks for storage access to save to the gallery.
- Audio: none. The system file picker hands the App only the audio file you choose.
- Billing (Android): to buy and manage Pro through Google Play.
- Internet and network state (Android): for Google Play's billing library, which adds them for its own use (section 6), and for crash reports and performance data, only if you turn them on (section 5).
- Live wallpaper (Android): the App includes a live wallpaper, which the system runs only if you choose it in the wallpaper preview.
The App does not ask for access to your camera, microphone, location, contacts or notifications.
9. How information is shared
We do not sell or rent personal data, and we do not share it for targeted or cross-context behavioural advertising. We disclose personal data only:
- to Google Firebase, which processes crash reports and performance data on our behalf as our service provider, as described in section 5;
- to the email services that forward and host our mailbox, which process messages on our behalf;
- when required by law, or when needed to protect the rights, safety or property of our users, the public or us;
- as part of a sale or transfer of the App. If that happens, we will tell you before your information becomes subject to a different policy.
10. International transfers
Google Firebase, our email services and the third-party services above may process data in countries other than yours, including the United States. Where data protection law requires it, these providers protect transfers with recognised safeguards, such as adequacy decisions or standard contractual clauses.
11. Security
The App keeps your data in its private storage, which other apps cannot read. It checks purchase confirmations on your device and keeps your Pro status in the system's secure storage: on Android, encrypted with AES-256-GCM using a key held by the Android Keystore that cannot be exported; on iPhone and iPad, in the Keychain, on this device only. The App's network requests on iPhone and iPad use encrypted (HTTPS) connections only, and the Android App does not allow unencrypted connections. An optional privacy screen (Settings › Privacy screen) hides the App's content in the app switcher and, on Android, blocks screenshots.
To protect the App and Pro, the App also checks on your device for signs of tampering: a modified or re-signed copy of the App, a debugger or hooking tools, a rooted or jailbroken device, an emulator, or an installation from outside an app store. It does this by reading technical facts, such as the App's signing certificate and how it was installed, the program libraries loaded into it, known rooting or jailbreak files, and process and system information. The results stay on your device and decide only whether Pro can be used. They appear as short codes in the diagnostics log, which reaches us only if you include it in a support email, and they are never sent anywhere else.
No method of transmission or storage is completely secure, but we work to protect the information we handle.
12. Children
The App is not directed to children under 13, and we do not knowingly collect personal data from children under 13. Through the App, we receive only crash reports and performance data, if they are turned on, and what you choose to send us by email. If a child uses the App, a parent or guardian should decide whether to turn on crash reports or performance data. If you believe a child has sent us personal data, contact us and we will delete it.
13. Your rights and choices
You control the information on your device. You can:
- turn crash reports and performance data on or off at any time in Settings › Privacy or on the privacy dashboard. Turning crash reports off also deletes crash reports not yet sent;
- delete drafts and creations in the App;
- use Settings › Privacy › Erase all data, which deletes your drafts, the creations stored in the App, your settings, the diagnostics log and the App's secure storage on this device. It does not affect files you saved to your gallery, or your subscription, which the store keeps;
- see what the App can access and how much storage it uses in Settings › Privacy › Privacy dashboard;
- uninstall the App to erase everything in its private storage on your device. Files you saved to your gallery stay there until you delete them.
For the personal data we hold, you may ask us to access, correct, delete or export your data, to restrict or object to our use of it, or to withdraw consent. Depending on where you live, you have these rights under:
- the EU and UK GDPR;
- California law (CCPA/CPRA), including the right to know, delete and correct, and the right not to be discriminated against for using your rights;
- Sri Lanka's Personal Data Protection Act, No. 9 of 2022;
- similar laws elsewhere.
Email apps.support@ailivex.com; for support messages, write from the address you used to contact us. We will answer within 30 days, or sooner if the law requires. You may also complain to your local data protection authority.
Crash reports and performance data are not linked to your name, email address or any account, so we usually cannot find the ones that came from you. The switches in Settings › Privacy are the way to stop them, and Google deletes them after the periods described in section 5.
We do not receive the billing diagnostics described in section 6, and they are not linked to an account we hold, so we cannot look them up or delete them; for data that Google or Apple hold for their own purposes, contact them directly. To cancel a subscription, use your Google Play or App Store account settings.
14. Do Not Track and Global Privacy Control
We do not track you across apps or websites, so there is nothing to change when your browser or device sends these signals.
15. Changes to this policy
We may update this policy. When we do, we will publish the new version on this page with a new effective date. Where the law requires, we will also give you additional notice.
16. Contact
Chamela Aluthgedara, Sri Lanka · apps.support@ailivex.com
Terms of Use
Please read these terms carefully. They include a disclaimer of warranties, a limitation of our liability, and rules for resolving disputes (sections 14 to 17).
1. Agreement
These Terms of Use ("Terms") are a legal agreement between you and Chamela Aluthgedara ("we", "us", "our") about the Lumivo app (the "App"). By downloading, installing or using the App, you agree to these Terms. Our Privacy Policy explains how we handle information; please read it too. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App and buy Pro only with the permission of a parent or legal guardian, who accepts these Terms for you and is responsible for your use of the App, including purchases. By using the App, you represent that you meet these requirements. The App is not intended for children under 13.
3. App store terms
If you got the App from Google Play, the Google Play Terms of Service also apply. If you got it from the Apple App Store, Apple's Licensed Application End User License Agreement also applies, and it takes precedence where it conflicts with these Terms for your use on Apple devices.
Google and Apple are not parties to these Terms. They are not responsible for the App, its content, maintenance, support or any claims about it. If the App fails to meet an applicable warranty, you may notify Apple, which may refund the amount you paid for it; Apple has no other warranty obligation for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms for your use of the App on Apple devices and may enforce them.
4. Licence
Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own lawful purposes. We reserve all rights not expressly granted.
5. Intellectual property and open-source components
The App, including its software, design, text, graphics, soundtracks, effects and trademarks, belongs to us or our licensors and is protected by intellectual property laws. The App includes open-source software and fonts, and Google libraries, under their own licences and terms, such as the BSD 3-Clause License, the Apache License 2.0 and the SIL Open Font License. Those licences govern those components; see Settings › Open-source licenses in the App for each component and its licence.
6. Your content
You keep all rights to the photos and audio you use with the App, and to the drafts, videos, GIFs, photos and wallpapers you create with it ("Your Content"), to the extent you hold those rights. Your Content is processed on your device. We do not receive it and claim no rights to it.
You are solely responsible for Your Content: for having every right, licence and consent needed to use, edit, animate, set to music, publish or share it, including the rights to any photo, music or audio that belongs to someone else and the consent of the people shown in your photos, and for everything you export, publish or share. Keep your own backups. Deleting a draft or creation, using "Erase all data" or uninstalling the App deletes the data it held permanently.
7. Acceptable use
You agree not to use the App to:
- break any law or regulation, or infringe the rights of others, including copyright, trademark, privacy and publicity rights;
- edit, animate or publish images of people without the consent the law requires;
- create or share content that is unlawful, defamatory, harassing, hateful, sexually exploitative of minors, or intended to mislead or defraud, such as altered images presented as real in order to deceive;
- copy, modify, decompile, reverse-engineer or redistribute the App, except where the law allows it despite this restriction;
- get around subscription checks, paid features or security measures, or use modified, repackaged or cracked versions of the App;
- interfere with the App or the store services it relies on.
8. Content included in the App
You may use the soundtracks, effects, looks, transitions and camera moves that come with the App in what you make with it, including commercially and on social media, without paying us royalties. You may not extract them from the App, or sell or distribute them on their own. The fonts included in the App are provided under their own open-source licences (section 5), and emoji are drawn by your device's system font, under its maker's terms.
Your exports may look different on other devices and in other apps, which may compress or change them, and a platform may limit or refuse what you post there. Some features, such as 4K or 60 fps export and live wallpapers, depend on what your device supports.
9. Lumivo Pro subscriptions and payments
- Lumivo Pro is offered as monthly or yearly auto-renewing subscriptions. What Pro costs, its billing period and any free trial or introductory offer are shown in the App and in the store before you buy.
- Google Play or Apple charges your store account when you confirm the purchase, and again at each renewal. Taxes are applied by the store where required. We do not process payments.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in your Google Play subscriptions or your App Store subscriptions, which you can also open from Settings › Membership › Manage subscription in the App. Uninstalling the App does not cancel a subscription. After you cancel, Pro stays on until the end of the period you paid for.
- If you start a free trial, it becomes a paid subscription when it ends unless you cancel at least 24 hours before then. A free trial or introductory offer is only for eligible subscribers, as the store's rules allow.
- If the amount charged for Pro changes, the store tells you in advance, as its rules require, and you can cancel before the change applies.
- Refunds are handled by Google Play or Apple under their refund policies, except where the law requires otherwise.
- To restore Pro after reinstalling the App, or on another device signed in to the same store account, use Settings › Membership › Restore purchases.
- Without a subscription you can create, edit and export with the free features; free exports include a small Lumivo mark.
- Pro keeps working offline for a limited time, after which the App checks your subscription with the store again. On rooted or jailbroken devices, emulators and copies not installed from an app store, and after the device clock was set back, the store must confirm Pro again first. Pro stays off on copies of the App that are modified, re-signed or run with a debugger or hooking tools; the free features keep working.
10. Third-party services
The App relies on services run by others: Google Play and the Apple App Store for downloads, purchases, updates and rating prompts, Apple's App Store lookup service for update checks on iPhone and iPad, Google Firebase for crash reports and performance data if you turn them on, and your device's photo picker, file picker, photo library, wallpaper and sharing features. Their own terms apply. We do not control these services and are not responsible for their availability, content or practices.
11. Updates and availability
We may update, change, suspend or discontinue the App or any feature at any time. Some updates are required: the App may ask you to install an update before you can keep using it. We do not guarantee that the App will always be available, error-free, secure, or compatible with every device or operating system.
12. Feedback
If you send us ideas or suggestions, we may use them freely, without any obligation or payment to you.
13. Termination
You may stop using the App at any time by uninstalling it; cancel any subscription separately in your store account. We may suspend or end your licence if you breach these Terms. When the licence ends, you must stop using the App. Sections 5 to 8 and 14 to 19 survive termination.
14. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP AND ALL ITS FEATURES, CONTENT AND EXPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. THIS INCLUDES ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT AND UNINTERRUPTED OR ERROR-FREE OPERATION.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. WE ARE ALSO NOT LIABLE FOR ANY LOSS OF DATA, CONTENT, PROFITS, REVENUE, GOODWILL OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE APP OR THESE TERMS, EVEN IF WE WERE TOLD OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR PRO IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) USD 10.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law. That includes liability for death or personal injury caused by negligence, liability for fraud, and the rights you have as a consumer under mandatory law.
16. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, damages, losses and expenses, including reasonable legal fees, arising from Your Content, your misuse of the App, or your breach of these Terms or of anyone else's rights.
17. Governing law and disputes
These Terms are governed by the laws of Sri Lanka, without regard to its conflict-of-law rules. Before bringing any claim, please email us so we can try to resolve the issue informally within 30 days.
The courts of Sri Lanka have exclusive jurisdiction over any dispute about the App or these Terms. If you are a consumer, however, you may also bring claims in the courts where you live, and you keep the protection of the mandatory laws of your country.
To the extent permitted by law, disputes are resolved individually and not as part of a class or representative action, and any claim must be brought within one year after it arises.
18. Export and sanctions
You confirm that you are not located in a country subject to comprehensive embargoes, and that you are not on any government list of prohibited or restricted parties. You agree to use the App in compliance with all applicable export and sanctions laws.
19. General
- These Terms, together with the Privacy Policy and any applicable store terms, are the entire agreement between you and us about the App.
- If any provision is found unenforceable, the rest remains in effect.
- Our not enforcing a provision is not a waiver of it.
- You may not transfer these Terms. We may transfer them as part of a sale or transfer of the App.
- We are not responsible for delays or failures caused by events beyond our reasonable control.
- If these Terms are translated, the English version prevails.
20. Changes to these Terms
We may update these Terms. The new version takes effect when it is published on this page with a new effective date. Where the law requires, we will also give you additional notice. We may also ask you to accept the updated Terms in the App. If you keep using the App after the change, you accept the updated Terms.
